Introduction
This document is a legal contract between you and the Application Provider, as well as an Agreement regarding your use of the Stash applications and services. By opening an account and/or using this application or service, you agree to be bound by the following terms and conditions of this user account agreement ("User Agreement").
By clicking "I agree" or accessing and using additional applications or services associated with your Account, you also agree to enter into this Agreement with Stash Fintech Limited and/or our Partners.
You also confirm that the information and documents you have provided to open this account are accurate and complete in compliance with extant legal and regulatory obligations.
Who We Are
Stash is an integrated service is a product of Stash Fintech Limited designed to help people spend, save, pay bills, transfer, and borrow using this account. Stash is a product of Stash Fintech Limited, a company duly incorporated in Nigeria.
In this Agreement, Stash and Stash Fintech Limited may be used interchangeably to refer to the Company and the App.
The product is offered with technical support and integrations with CBN licensed companies such as Flutterwave Inc, Paystack Inc and Team Apt Inc. These companies process card and payment transactions on behalf of Stash. They have obtained the highest level of security certifications required by regulators in Nigeria.
Scope
This Agreement regulates our relationship with you and helps us comply with local and international regulations. In line with global standards, we reserve the right to make changes to the terms and conditions in this Agreement, we promise to notify you of these changes as they occur.
Periodic reviews are necessary to improve upon our service delivery and ensure compliance with regulatory provisions and global best practices.
By creating an account, you expressly confirm that you have read the terms and conditions contained in this Agreement and you agree to abide by the terms, conditions, rules, regulations and guidelines as may be prescribed by Stash Fintech Limited or extant regulators.
In the event of a multi-party or joint account, you agree that one account holder indicating his/her acceptance of the agreement shall be deemed acceptance of the Agreement by all account holders.
Contractual Obligations
Your account with us provides a channel of communication. When you select a product or offering on this App, you make an offer to us for the purchase of the product(s) you have selected, subject to the stated terms of purchase and the terms and conditions contained in this Agreement. You further confirm to us that you have authorized access to funding or debit accounts you provide in the course of using this App.
Your personal information is confidential and only be used in strict compliance with existing regulations. You are responsible for debit orders authorized from your account.
Warranties
By using this App, you confirm that you are a natural person, are eighteen (18) years of age or older. Please note that any registration by, use of or access to the App by any natural person under 18 is unauthorized, unlicensed and in violation of these terms of use.
The tools and products we provide are calibrated to provide our Customers with the maximum user satisfaction. It is not intended to constitute financial advice and you may wish to consult a financial adviser for additional advice.
You further warrant that you are authorized to share the information and materials submitted to Stash and that will not use the App in any unlawful manner or in any other manner that can damage, disable, overload, or impair the site.
In addition, you warrant not to use the App to:
- Upload, post, transmit, share, store or otherwise make available any content that we deem to be harmful, threatening, unlawful, defamatory, infringing, abusive, inflammatory, harassing, vulgar, obscene, fraudulent, invasive of privacy or publicity rights, hateful, or racially, ethnically or otherwise objectionable;
- Except where authorized by the company, register as more than one user account, register for a user account on behalf of an individual other than yourself, operate a user account on behalf of or for the benefit of any person who is not eligible to register for or operate a user account in their own name, or register for a user account on behalf of any group or entity (other than approved investment accounts opened on behalf of legal entities, joint consumer loan accounts or accounts opened for purposes of participating in our small business lending program);
- Impersonate any person or entity, or falsely state or otherwise misrepresent yourself, your age or your affiliation with or authority to act on behalf of any person or entity;
- Upload, post, transmit, share or otherwise make available any unsolicited or unauthorized advertising, solicitations, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation;
- Upload, post, transmit, share, store or otherwise make publicly available on the site any private information of any third party, including, without limitation, addresses, phone numbers, email addresses, social security numbers and credit card numbers;
- Solicit personal information from any natural person under 18 or solicit passwords or personally identifying information for commercial or unlawful purposes from any user;
- Upload, post, transmit, share or otherwise make available any material that contains software viruses or any other malicious or tracking computer code, files or programs designed to track, interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
- Intimidate or harass another user;
- Upload, post, transmit, share, store or otherwise make available content that would constitute, encourage or provide instructions for a criminal offense, violate the rights of any party, or that would otherwise create liability or violate any local, state, national or international law;
- Use or attempt to use another's account, service or system without authorization from that person and the company, or create a false identity on the service or the site; or
Intellectual Property
Copyright, Trademarks, Trade Secrets and Proprietary Information
Stash is a product of Stash Fintech Limited; Stash, the Stash Logo and other brand extensions are also the intellectual property of Stash Fintech Limited and except as otherwise stated on this site, all other intellectual property is the exclusive property of Stash Fintech Limited or used with express permission of the copyright and/or trademark owner.
Any violation of this policy may result in a copyright, trademark or other intellectual property right infringement action that may expose end user to civil and / or criminal penalties.
This App contains copyright protected material, trademarks, and other proprietary information, embedded in and inclusive of, but not limited to, text, software, photos, video, graphics, music, sound protected by Nigerian copyright law (the Copyright Act, LFN 2004), international treaties and conventions. Stash Fintech Limited owns the Copyright in the selection, coordination, arrangement and enhancement of such content, as well as in the content original to it. You may not modify, publish, transmit, participate in the transfer or sale, create derivative works, or in any way exploit, any of the content, in whole or in part without the express written permission first obtained in writing from stash fintech limited.
Dispute Resolution and Governing Law
All questions with respect to the construction of this agreement, and the right and liabilities of the parties hereto, shall be governed by the laws of the Federal Republic of Nigeria. The parties also agree that the venue for this agreement shall be the Federal Capital Territory, Abuja, Nigeria.
Any controversy, claim or dispute between the parties hereto, shall be conducted by and submitted to a Single Mediator (“Mediator”) selected from and administered by Commercial Intermediates Limited in accordance with its Mediation Rules & Procedures.
The Mediator shall be authorized to award compensatory damages, but shall not be authorized to award non-economic damages such as for emotional distress, or pain and suffering or punitive or indirect, incidental or consequential damages.
Within fifteen (15) calendar days after conclusion of the mediation, the mediator shall issue a written award and a written statement of decision describing the material factual findings and conclusions on which the award is based, including the calculation of any damages awarded. Each party shall fully perform and satisfy the mediation award within fifteen (15) days of the service of the award. Judgment on the award may be entered by any court of competent jurisdiction.

Stash Fintech Limited does not tolerate spam. We advise that you set your browser preferences. Please report spam or spoof emails to Stash Fintech Limited, forward the email to support@stashng.com. Stash Fintech Limited reserves the right to scan and manually filter messages, posts, comments and reviews to check for spam, viruses, phishing attacks and other malicious activity or illegal or prohibited content.
Disclosure
We may disclose personal information to comply with legal requirements, enforce our policies, respond to claims that a listing or other content violates the rights of others, or protect anyone's rights, property, or safety. Such information will be disclosed in accordance with this privacy policy and applicable laws and regulations. As stated above, we do not disclose your personal information to third parties for their marketing purposes without your explicit consent.
Data Protection and Privacy
We do not sell or rent your personal information to third parties for their marketing purposes without your explicit consent. We may combine your information with information we collect from other companies and use it to improve and personalize our services, content and advertising.
If you do not wish to receive marketing communications from us, you can indicate your communications preference in your Stash account, or within the direct communication from us. Your sensitive data such as National identity Number (NIN), Bank Verification Number (BVN) and debit card details are not stored on our database.
As a precondition, we need your permission to send you administrative and promotional emails including information regarding your account activity, purchases, updates about our products and promotional offers. You can opt-out of our promotional emails anytime by clicking the unsubscribe link at the bottom of any of our email correspondences.
